The Buncombe County Sheriff’s Office Civil Process Division serves a range of court documents, including summons, writs of possession, foreclosures, executions, claim and deliveries, subpoenas, restraining orders, child custody orders, show cause orders, and child support warrants.

Required Paperwork Common Filings

  • An envelope with a stamp addressed to the defendant(s)
  • 2 copies of the complaint
  • 3 copies of the summons
  • 3 copies of the writ
  • An unsealed envelope with a stamp addressed to the defendant(s)

Fees depend on where papers are being served. Within North Carolina, it's $30 per person/paper. Out-of-state service costs $50 per person/paper. One exception: Ex Parte Domestic Violence Protection Orders (DVPOs) are served free of charge, in or out of state. Pay directly to the Buncombe County Sheriff's Office. They accept cash (exact change only), certified checks, and money orders. Personal checks and credit/debit cards aren't accepted.

Payment tip: Bring exact cash if paying in person. Otherwise, use a certified check or money order - no personal checks, no cards.

The person being served must reside within Buncombe County. You'll need to provide a physical street address - P.O. boxes won't work.
