For Attorneys: How to Protect Attorney-Client Calls at Jefferson County Jail (LMDC)
If you expect attorney-client calls from someone held at LMDC, you can request that up to three phone numbers be exempted from recording. The key: complete the paperwork correctly and listen for the recorded warning at the start of any call.
LMDC lets attorneys request exemption from recording for up to three ten-digit phone numbers - specifically for privileged attorney-client communications. Once you've completed the application process correctly, LMDC won't record or monitor inmate calls to those numbers unless a court has authorized it in advance.
Note: Protection only kicks in after you've fully completed the exemption process. And LMDC can still record calls if a judge has given prior approval.
Start by submitting the attorney-client exempt phone-number form, then move fast on the documentation step. Within 3 business days of submitting the form, email a scanned copy of your Bar Association membership card to BarCard@louisvilleky.gov. That email is what triggers LMDC to start processing your request.
- ✓ Submit the attorney-client exempt phone-number form (with up to three ten-digit numbers).
- ✓ Within 3 business days, email a scanned copy of your Bar Association membership card to BarCard@louisvilleky.gov to begin processing.
Once LMDC has both your form and bar card, expect up to 10 business days for processing. Factor that into your timeline - especially if you're anticipating time-sensitive calls early in the representation.
This isn't a one-time setup. LMDC requires annual renewal between January 1 and January 31.
Warning: If a call from LMDC starts with a notice that it may be recorded, treat it as unprotected. Assume your number hasn't been blocked for that call.
LMDC also puts the responsibility on you to control how exempt numbers are used. These lines are for privileged attorney-client communications in the regular course of your practice - not a workaround for friends, family, investigators, or anyone else to have unmonitored conversations with an inmate.
- Listen at the start of every call - if you hear the verbal recording notice, presume the call is not protected and that the number has not been blocked for that call.
- Treat exempt numbers as privilege-only lines - don’t allow third parties to use the exempted numbers for communications with inmates that wouldn’t fall within attorney-client privilege.
- Keep your exempt list tight - only submit the numbers you actually use in your practice for privileged attorney-client calls (up to three ten-digit numbers).
