Before paying Westchester County Jail bail by credit card: who gets returned funds?
If you pay someone else's Westchester County Jail bail by credit card, any bail the court later orders returned goes to the defendant, not back to your card. Know that before you commit funds.
For credit-card bail at Westchester County Jail, the county completes all required documents in the name of the person being bailed out. As the cardholder, you must agree to give up any claim to the funds you post.
The bail funds you post by credit card become the property of the person you are bailing out.
When the case or charges are resolved, any bail the court orders returned to the defendant goes directly to the defendant. It is not credited back to your credit card. This applies only to bail funds the court orders returned.
The person you are bailing out is checked for active warrants or other legal holds, and that check can take time. Outstanding warrants may prevent the bail from being completed, so paying does not guarantee immediate release.
